Recently I have devoted a great amount of time focusing on one party rule as the goal of the democrat party. With further research and the over use of executive orders I begin to wonder about the evolution of one man rule. How did Executive Orders come to be, when did it start, and how do we override them. In recent years I have heard more and more of Executive Orders being issued and in the recesses of my mind I begin to think that this is a way one man (person) can seek to obtain One Man Rule similar to a Dictatorship in our country. I hope to inform and answer some of these questions.
Executive Orders are not new. The first was issued by President George Washington on June 8, 1789 and directed the heads of all federal departments “to impress him with a full, precise, and distinct general idea of the affairs of the United States” in their respective fields.
The Constitution of the United States does not directly define or give the president authority to issue executive orders or presidential actions, memoranda and proclamations. The accepted power is derived from the implied verbiage in Article II of the Constitution which states that as head of the United States, and commander in chief of the armed forces he “shall take care that the laws be faithfully executed.” Presidential Executive Orders instruct the government how to work within the parameters already set by Congress and the Constitution. Interpreting the article in this manner allows the president to push through policy changes without the approval of Congress. When issued, the executive order has the force of law.
There are three ways an Executive Order can be stopped or overturned; Congress, The Courts, Presidential.
Congress: The best and quickest way to overturn an order is for Congress to take action and repeal the particular act called for, however as with any bill the president can veto returning it to congress to start action again. A new law created this way stops the order immediately and prevents circumventing it in the future if the veto if used is overridden.
The Courts: The second method to overturn is to file legal action and petition for relief through the courts. This action is slower, more time consuming and may result in delays for appeals etc. Every appeal along the way lengthens the process and cost we taxpayers more in legal fees
Presidential: The third way is for a future president to issue a new Executive Order to override the order issued by his predecessor. We have witnessed this in the first days of our most recent presidents.
Since George Washington started the process of issuing Executive orders there have been 18,934 issued. William Henry Harrison is the only president, so far, to not issue an Executive Order with Franklin D. Roosevelt leading the pack with 3,721 while in office. The average is 412 per president. In recent times President Barack Obama abused his authority with 276 and, Joseph R. Biden has followed with 138 so far and remains in office to issue more as he pleases. President Donald J. Trump, while serving four years issued 220 Executive Orders overturning many of the decrees of Barack Obama.
Interesting summary, at least interesting to me. There have been 46 presidents.
23 were Republican
17 were Democrat
6 were other (Whig, Etc.)
There have been 18,934 Executive Orders issued.
10,070 were by Republicans
8,821 were by Democrats
43 were by others
It remains the ultimate responsibility of “we the people” through our representative form of government to approve, disapprove, allow or block the actions of power hungry politicians. If allowed to go to extremes we could end up with a country being ruled by one person or a politburo of people with one figurehead. This is not where America should be but is where certain forces are trying to lead the new Amerika.
Vote, vote wisely, and watch what our leaders are doing and support in every manner within your power to keep America free. Forget the hate and anger you may have toward one person and vote for a leader that truly loves America.
